Boston federal district judge Indira Talwani said in her ruling on Monday that the text and structure of the tax and spending bill signed by President Trump clearly show that it is intended to punish Planned Parenthood Federation of America and all its member organizations, and "the plaintiffs are likely to prove that Congress had punitive intent." She also ruled that the bill violates the equal protection clause of the Fifth Amendment of the Constitution and constitutes an improper restriction on the right of member organizations that do not provide abortion services to associate with their headquarters, which may violate the First Amendment.
